These Terms constitute a legally binding agreement made between you, whether personally or on behalf of an entity, concerning your access to and use of the Site and Services. You agree that by accessing the Services, you have read, understood, and agreed to be bound by all of these Legal Terms. You are granted a limited, non-sublicensable license to access and use the Sites for your informational, non-commercial, and personal use only Such license is subject to these Site Terms and does not include: (a) any resale or commercial use of the Sites or the Site Materials therein; (b) the collection and use of any images or descriptions; (c) the distribution, public performance or public display of any Site Materials; (d) modifying or otherwise making any derivative uses of the Sites and the Site Materials, or any portion thereof; (e) use of any data mining, robots or similar data gathering or extraction methods; (f) downloading (other than the page caching) of any portion of the Sites, the Site Materials or any information contained therein, except as expressly permitted on the Sites; or (g) any use of the Sites or the Site Materials other than for its intended purpose. Orion Innovations, the Orion Innovations logo, and any other Orion Innovations product or service name, tag line, or slogan contained in the Sites are trademarks of Orion Innovations, and may not be copied, imitated, or used, in whole or in part, without the prior written permission of Orion Innovations or the applicable trademark holder. You may not use any metatags or any other “hidden text” utilizing “Orion Innovations" or any other name, trademark or product, or service name of Orion Innovations without our prior written permission. In addition, the look and feel of the Sites, including all page headers, custom graphics, button icons, and scripts, is the service mark, trademark, and/or trade dress of Orion Innovations and may not be copied, imitated, or used, in whole or in part, without our prior written permission. 8. Applicable Law and Venue

These Site Terms and your use of the Sites will be governed by and construed in accordance with the laws of EEUU, applicable to agreements made and to be entirely performed within EEUU, without resort to its conflict of law provisions. You agree that any action at law or in equity arising out of or relating to these Site Terms shall be filed only in the courts of EEUU and you hereby irrevocably and unconditionally consent and submit to the exclusive jurisdiction of such courts over any suit, action or proceeding arising out of these Site Terms.

9. NoGag Product Subscriptions

Your subscription will continue and automatically renew unless canceled. You consent to our charging your payment method on a recurring basis without requiring your prior approval for each recurring charge, until such time as you cancel the applicable order. Orion Subscription EZ-Cancellation Guarantee: If you are not satisfied with the results of your purchase, you may cancel your subscription at any time.  To cancel your subscription, please contact us at customerservice@nogag.com or chat with us at www.nogag.com.  We will collect the needed account information to process your cancellation.  Any value-added promotions related to the subscription will be fulfilled only with completed subscription terms. Orion’s standard 12-month Customer Guarantee pertains only to those products shipped within thirty (30) days of the Cancellation Date.  We may, from time to time, make changes to the subscription fee and will communicate any price changes to you in accordance with applicable law.

10. NoGag Product 12-Month Customer Guarantee:

If you are not satisfied with the results of your purchase up to the last serving, we will replace it or refund you at your option.  To request a refund or replacement, a minimum of a single serving must be returned.  You are responsible for the cost of shipping the product back to Orion. Refund processing or shipment of replacement product will occur within fourteen (14) days from the date the returned product is received.  For products purchased under a Subscription, only those items shipped within the last thirty (30) days from the date of refund request shall be eligible.  Guarantee only applicable to product packages of five (5) or more servings. 

11. Termination

Notwithstanding any of these Site Terms, Orion Innovations reserves the right, without notice and in its sole discretion, to terminate your license to use the Sites and to block or prevent your future access to and use of the Sites.

12. Severability

If any provision of these Site Terms shall be deemed unlawful, void, or for any reason is unenforceable. That provision shall be deemed severable from these Site Terms and shall not affect the validity and enforceability of any remaining provisions.
